Welcome to VitalTouch Home Care. These Terms of Service ("Terms") govern your use of our website vitaltouchcares.com and our home care services. By accessing our website or using our services, you agree to be bound by these Terms.

Services Overview

VitalTouch Health Network Inc., doing business as VitalTouch Home Care, provides non-medical home care services including:

  • Homemaking services (cleaning, laundry, meal preparation)
  • Companionship and social engagement
  • Transportation assistance
  • Personal care assistance (provided by CNAs)
  • Alzheimer's and dementia care support

Important Note

Our services are non-medical in nature. We do not provide skilled nursing, medical treatments, or administer medications.

Eligibility

To use our services, you must:

  • Be at least 18 years of age (or have a legal guardian arrange services)
  • Provide accurate and complete information
  • Have the legal authority to enter into this agreement (or be the authorized representative)

Service Agreement

Prior to commencing care, clients or their authorized representatives will enter into a separate Service Agreement that outlines:

  • Specific services to be provided
  • Schedule and hours of care
  • Rates and payment terms
  • Cancellation policies
  • Rights and responsibilities

The Service Agreement, along with these Terms, governs our relationship with clients.

Payment Terms

Medicaid Clients

For clients receiving Medicaid-funded services, we bill Medicaid directly. Services are subject to Medicaid approval and coverage limitations.

Private Pay Clients

Private pay clients are responsible for payment according to the terms outlined in their Service Agreement. Payment is typically due upon receipt of invoice.

Cancellation and Rescheduling

We understand that schedules change. Please provide at least 24 hours notice for cancellations or schedule changes when possible. Specific cancellation policies are outlined in your Service Agreement.

Client Responsibilities

Clients and their families agree to:

  • Provide accurate information about care needs and health conditions
  • Maintain a safe environment for caregivers
  • Treat caregivers with respect and dignity
  • Notify us promptly of any changes in condition or care needs
  • Not request caregivers to perform tasks outside their scope of practice
  • Not solicit or hire our caregivers directly

Our Responsibilities

VitalTouch Home Care agrees to:

  • Provide qualified, background-checked caregivers
  • Maintain appropriate insurance coverage
  • Supervise and support our caregiving staff
  • Respond promptly to concerns and feedback
  • Maintain confidentiality of client information
  • Comply with all applicable laws and regulations

Non-Solicitation

Important

Clients agree not to directly hire, solicit, or contract with any VitalTouch caregiver outside of our agency during the service period and for 12 months following termination of services. Violation of this provision may result in a placement fee.

Limitation of Liability

VitalTouch Home Care provides non-medical care services with reasonable skill and care. However:

  • We are not responsible for outcomes related to the client's underlying health conditions
  • We do not guarantee specific health outcomes
  • Our liability is limited to the extent permitted by law
  • We are not liable for circumstances beyond our reasonable control

We maintain appropriate liability insurance for our services.

Website Use

When using our website, you agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the website
  • Transmit viruses or harmful code
  • Collect information about other users
  • Interfere with the website's operation

Intellectual Property

All content on our website, including text, images, logos, and design, is the property of VitalTouch Home Care and is protected by copyright and trademark laws. You may not use our content without our written permission.

Termination

Either party may terminate services with appropriate notice as specified in the Service Agreement. We reserve the right to terminate services immediately if:

  • The client's environment becomes unsafe for our caregivers
  • There is abusive behavior toward our staff
  • Payment obligations are not met
  • The client's needs exceed our scope of services

Dispute Resolution

We are committed to resolving any concerns promptly and fairly. If you have a complaint or dispute:

  • We will investigate and respond within a reasonable timeframe
  • If unresolved, disputes will be governed by the laws of the State of Illinois

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on our website. Continued use of our services after changes constitutes acceptance of the new Terms.

Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

These Terms, together with our Privacy Policy and any Service Agreement, constitute the entire agreement between you and VitalTouch Home Care.
